Ted Regnante concentrates his practice in real estate development and land use, zoning, wetlands and environmental issues. While Ted has significant experience in all areas of real estate development, over the past several years he has become one of Massachusetts' most well-known and well-regarded attorneys in the area of affordable housing under Chapter 40B, representing developers throughout the Commonwealth before local zoning boards, the Housing Appeals Committee and in both the trial and appellate courts. He has served as a member of the Department of Housing and Community Development Housing Appeals Committee Advisory Committee, which served as a catalyst for the implementation of revised regulations and procedures designed to streamline the hearing process at the Housing Appeals Committee. Additionally, Ted has conducted numerous lectures on Chapter 40B, including programs for Massachusetts Continuing Legal Education, Citizens Housing and Planning Association, and the Inns of the Court.
Ted is also very active in Chapter 40R Smart Growth Overlay Zoning and has recently presented a training session regarding Chapter 40R to representatives from the towns of Hamilton and Wenham.
Ted has substantial experience with conventional development as well, including working with developers to draft bylaws allowing cluster development using Smart Growth Guidelines. Ted has recently obtained approvals for a 36 unit condominium development in Manchester-by-the-Sea known as Coolidge Commons Manchester, which included coordinating a development team consisting of civil engineers, wetlands specialists, traffic engineers, landscape architects, and architects to obtain approvals including a Chapter 40B comprehensive permit, an Order of Conditions under the Wetlands Protection Act, a Disposal Works Permit pursuant to Title V, and a State Highway Access Permit from Mass Highway. Other recent approvals include securing an approval for a Benevolent Order of the Moose Lodge in Merrimac pursuant to G. L. c. 40A, 3 (the Dover Amendment), securing a Special Permit pursuant to G. L. c. 40A, 6 from the Rowley Board of Appeals to allow the operation of a winery and all permits for the largest Mercedes Dealership on the east coast.
In addition to real estate, Ted's practice includes commercial lending and corporate law relating to small businesses.
Ted is a member of the Board of Directors (and is the former Treasurer) of the state Real Estate Bar Association and is presently serving on the Governor's Task Force studying revisions to Chapter 40A, the Massachusetts Zoning Enabling Act. Ted is also a contributing editor of Land Law, commenting on Chapter 40B case law. Ted has been named a Super Lawyer of 2009 in real estate law and is rated AV the highest rating for a lawyer by Martindale Hubbell the national rating service for attorneys.
Ted has been a practicing attorney since 1962 after having served as a Captain in the Judge Advocate General Corps.
